WILMINGTON, Del. — A Delaware trial judge has denied a motion by On Semiconductor Corp. (Nasdaq: ONNN) to dismiss a lawsuit by a former Arizona employee alleging that exposure to workplace chemicals caused her daughter’s birth defects.
Superior Court Judge Jan R. Jurden ruled March 27 that Arizona law does not preclude the child’s claim for damages for in utero exposure, nor are plaintiffs limited to workers’ compensation remedies because of the mother’s former employment.
