LOUISVILLE, Ky. –– A Kentucky appellate court has affirmed workers’ compensation benefits for a man who claims that exposure to chemicals and hazardous dust during his employment with a resin cartridge manufacturer caused occupational asthma.
The Kentucky Court of Appeals held March 15 that , saying that an Administrative Law Judge’s reliance on a university evaluator’s injury assessment was not erroneous and that Ronald Hayes’ employer failed to provide sufficient evidence to overcome the evaluation.
