La. Court Gives Contract Worker 30 Days to Amend Silica Suit Against Citgo

LAKE CHARLES, La. — A federal judge agreed with Citgo Petroleum Corp. that a contract worker’s silica injury complaint was deficient, but he gave the plaintiff 30 days to amend or face dismissal.

Judge James T. Trimble Jr. of the U.S. District Court for the Western District of Louisiana said March 4 in denying Citgo’s motion to dismiss that while the Federal Rules of Civil Procedure require that a complaint afford a defendant fair notice of the claim, the rules also provide that a plaintiff be given the opportunity to amend before facing dismissal.
