CINCINNATI — An Ohio federal judge has denied CSX Transportation Inc.’s (NYSE: CSX) renewed motion for judgment as a matter of law or a new trial on claims by a railroad engineer that he was injured from accidental exposure to chlorine and other substances.
Senior Judge Herman J. Webber of the U.S. District Court for the Southern District of Ohio said Feb. 21 that CSX failed to show that the verdict reached in favor of plaintiff Charles Sunnycalb was against the weight of the evidence, or that the court erred in instructing the jury on causation.
