ST. LOUIS — A U.S. magistrate judge has awarded partial summary judgment to Norfolk Southern Railway Co. (NYSE: NSC) on claims by a former worker in its bridge and building department that exposure to hazardous workplace materials caused his leukemia.
Magistrate Judge Terry I. Adelman, who is considering motions in the case pending in the U.S. District Court for the Eastern District of Missouri with the consent of the parties, ruled Feb. 11 that there are no facts in dispute concerning plaintiff William T. Wiser’s claims for mental anguish, past and future wage losses and diminished earning capacity.
