TOLEDO, Ohio — More than 400 neighbors of a Nucor Steel Marion Inc. (NYSE: NUE) mill in northern Ohio are seeking damages for what they say is mental anguish and property damage caused by the plant’s release of “dangerous levels” of manganese.
Plaintiffs filed the action Dec. 26 in the Marion County (Ohio) Court of Common Pleas, but Nucor removed it to the U.S. District Court for the Northern District of Ohio Jan. 18, asserting complete diversity and federal jurisdiction under the Class Action Fairness Act (28 U.S.C. § 1332[d]).
