LAS VEGAS — A “home state controversy” exception in the Class Action Fairness Act was cited by a federal judge as the basis for awarding summary judgment to Wynn Resorts Ltd. (NASDAQ: WYNN) in a secondhand smoke class action brought by Las Vegas casino workers.
Judge Lloyd D. George of the U.S. District Court for the District of Nevada granted Wynn’s motion for summary judgment Feb. 6, saying that because the defendant and 99 percent of putative plaintiffs are Nevada residents, the court lacked subject matter jurisdiction under CAFA.
