FORT LAUDERDALE, Fla. — A federal judge has remanded a Florida man’s employer negligence and breach-of-contract action to state court after concluding that the removal notice filed by the employer’s insurer was untimely.
Judge Kenneth A. Marra of the U.S. District Court for the Southern District of Florida ruled Jan. 31 that third-party claims brought by plaintiff Eddie Hoggins against Mid-Continent Casualty Co. did not change the date on which the action was begun, and that Mid-Continent’s bid to remove the case three years after it was filed was untimely.
