ALEXANDRIA, Va. — A U.S. district judge has dismissed an environmental group’s suit to halt U.S. Environmental Protection Agency studies in which human subjects are said to have been intentionally exposed to diesel fumes or particulate matter, saying the plaintiff lacks standing and the court lacks jurisdiction.
Judge Anthony J. Trenga of the U.S. District Court for the Eastern District of Virginia ruled Jan. 31 that no members of the American Tradition Institute Environmental Law Center have been adversely affected by the “CAPTAIN” study into the effects of particulates.
