NEW YORK — A New York appellate court has reversed a trial court’s ruling in favor of a teacher claiming a link between her breathing difficulties and classroom toxins, saying the district was entitled to summary judgment because of the teacher’s failure to provide any evidence of specific causation.
The New York Supreme Court Appellate Division, First Department, ruled Oct. 4 that the plaintiff’s experts offered an insufficient basis for their opinions linking mold, dust and insects to Wayne Cleghorne’s asthma.
The appellate court ordered judgment entered in accordance with its opinion.
