Trial Court Allows Plaintiffs’ Medical Experts to Testify on Chlorine Exposure

CINCINNATI — A federal judge has allowed a railroad engineer’s medical experts to testify that his pulmonary illness was caused by accidental chlorine exposure, saying that precise measurements of the chemical are not needed in cases of sudden or accidental exposure.
However, the judge also limited contrary trial testimony by a defense expert, saying that her opinion that the plaintiff’s condition might have been related to influenza was too speculative.
The case is currently in trial before Senior Judge Herman Weber of the U.S. District Court for the Southern District of Ohio. Jury selection was to begin Aug. 27.
