NEW ORLEANS - Louisiana's Fourth Circuit Court of Appeal has affirmed damage awards to 46 state workers who claimed injury from a mold-infested workplace, rejecting the state's argument that individual class members failed to prove that injuries were specifically caused by mold exposure. Watters, et al. v. Department of Social Services, et al., No. 2011-CA-1174 (La. Ct. App., 4th Cir.).
The Court of Appeal held March 13 that the $35,000 benchmark awards to 46 of 50 class members in the first flight of cases to be considered followed the appellate court's earlier rulings and were not excessive or an abuse …
