4th Circuit Rejects Teacher's Constitutional Claim Over Mold Exposure

RICHMOND, Va. - The 4th Circuit Court of Appeals has affirmed the dismissal of an elementary school teacher's lawsuit alleging that a local school board violated her constitutional rights by exposing her to mold and bacteria in her classroom. Hood v. Suffolk city School Board, et al., No. 11-1044 (4th Cir.).

The federal appellate panel ruled in an unpublished opinion March 13 that a lower court did not err in concluding that the board's alleged failure to keep the plaintiff teacher free from workplace hazards did not constitute a cognizable claim under the Due Process clause of the U.S. Constitution.
