Court Affirms Summary Judgment for School Contractors in Construction Worker Suit

NEW YORK - A New York appellate court has affirmed summary judgment for building contractor defendants after finding that a construction worker who claims to have suffered an exacerbation of an existing illness failed to show that defendants were on notice of any workplace hazards. Stephens v. Skanska USA Building Inc., et al., No. 6825 118106/2006 (N.Y. Sup. Ct. App. Div., 1st Dept.).

The New York Appellate Division, First Department, also ruled Feb. 16 that Dylan Stephens failed to provide evidence that he was injured because of some condition at the worksite.
