MINEOLA, N.Y. - A New York court has dismissed five counts in a complaint linking a former Nassau County worker's death to long-term exposure to pesticides, but rejected defendants' bid to dismiss the action. Terrillion v. Loveland Products, Inc., No. 22734/2010 (N.Y. Sup. Ct., Nassau Cty.).
Nassau County Supreme Court Justice Denise Sher ruled Dec. 19 that while a wrongful death claim was time-barred and the state doesn't recognize a preconception genetic injury claim, other state-law claims are viable and the court will not require specific conduct allegations or product identification at this stage of the proceedings.
