CLEVELAND - A federal judge has ordered a welding plaintiff to undergo additional medical testing, saying the electrophysiological tests are not intrusive and defendants have shown good cause for the request. Baxter, et al. v. Lincoln Electric Co., et al., No. 1:08-WF-17037 (N.D. Ohio).

Judge Kathleen M. O'Malley said in her Jan. 12 order that the circumstances are similar to those in another Welding Fumes bellwether case in which the court rejected the plaintiff's objections and granted a similar order (See Byers v. Lincoln Elec. Co., 2008 WL 3200277 [N.D. Ohio Aug. 5, 2008]).
