SANTA ANA, Calif. - A California appellate court has rejected an appeal by a former office worker who argued that a trial court erred in preventing her physician and co-workers from testifying about alleged workplace contaminants underlying her disability discrimination lawsuit. Smith v. County of Orange, No. G043779 (Calif. Ct. of App., 4th Dist.).
California's Fourth Appellate District said in its unpublished Jan. 13 opinion that the Orange County Superior Court did not abuse its discretion in excluding the testimony and that it was harmless error to allow jurors to see evidence of the physician's prior disciplinary record.
