D.C. Circuit Overturns EPA Emission Standards for Portland Cement Facilities

WASHINGTON, D.C. - A federal circuit court has ordered the U.S. Environmental Protection Agency to reconsider emissions standards set for Portland cement facilities in September 2010, saying its decisions were arbitrary and capricious. Portland Cement Association v. EPA, et al., No. 10-1358 (D.C. Cir. Ct.).

The D.C. Circuit Court of Appeals declined to order a stay during reconsideration, however, saying in a Dec. 9 per curiam opinion that it is unlikely that its ruling will result in any substantial changes to the National Emissions Standards for Hazardous Air Pollutants or New Source Performance Standards applicable to cement facilities.
