N.J. Court Says Extermination Company Proper Defendant in Chemical Exposure Case

TRENTON, N.J. -- A New Jersey federal court has denied the efforts of an extermination company to dismiss a chemical exposure lawsuit in which it was named a defendant, finding that the plaintiff sufficiently pled allegations that the company concealed risks inherent with using the chemicals. Blackshear, et al. v. Syngenta Crop Protection Inc., et al., No. 10-3585 (D. N.J.).

In the Oct. 31 ruling, the U.S. District Court for New Jersey also remanded the case to state court on grounds that complete diversity does not exist since the defendant is a proper party in the lawsuit.
