WASHINGTON, D.C. - Lincoln Electric Co. has asked the Judicial Panel on Multidistrict Litigation to vacate a conditional remand order that would move a welding fumes case from the MDL court in Ohio to Minnesota for retrial. In re: Welding Fume Product Liability Litigation, MDL No. 1535 (JPML).
Lincoln Electric filed its Motion to Vacate on Oct 28, saying that the MDL court correctly noted in its Oct. 7 remand order that plaintiff David Mann waived his right to remand to the U.S. District Court for the District of Minnesota, where his case was originally filed.
