Court Dismisses Preconception Injury Claims Against Semiconductor Firm

WILMINGTON, Del. - A Delaware trial court has dismissed birth defect claims brought against Texas Instruments on behalf of the child of a former employee, concluding that suit is barred by the workplace exclusivity provisions of Texas' Workers' Compensation Act. Peters v. Texas Instruments, No. 10C-06-043 JRJ (Del. Super. Ct., New Castle Cty.).

Delaware Superior Court Judge Jan Jurden granted Texas Instruments' motion to dismiss on Sept. 30, noting that the application of Texas law was undisputed by the parties.
