CLEVELAND - The plaintiff in an upcoming welding fume trial has withdrawn neurologist Paul Nausieda as a trial witness, leading the court to deny motions to exclude and to compel a fluoradopa-PET scan as moot. Street v. Lincoln Electric, et al., No. 1:06-cv-17026 [In re: Welding Fume Products Liability Litigation, MDL No. 1535] (N.D. Ohio).
The withdrawal of Dr. Nausieda came during the conclusion of a Daubert hearing held in the U.S. District Court for the Northern District of Ohio on Sept. 13. Judge Kathleen M. O'Malley denied Lincoln Electric and ESAB Group's motion to exclude as moot.
