COLUMBUS, Ohio - An Ohio appellate panel has - for the second time - reversed summary judgment awarded to an employer for failing to protect workers from catalytic converter insulation dust even after it allegedly knew the dust was harmful. Conley v. Faurecia Exhaust Systems Inc., et al., No. 2009 CA 26 (Ohio Ct. App., 2nd Dist., Miami Cty.).
The Second District Court of Appeal sustained Willard S. Conley Jr.'s assignments of error, ruling on Sept. 2 that Conley's expert's deposition testimony did not contradict an earlier affidavit.
