CLEVELAND - Defendants in a welding fume lawsuit awaiting a November trial have followed a stipulated dismissal of fraud and warranty claims by moving for summary judgment for all remaining causes of action. Street v. Lincoln Electric Co., et al., No. 1:06-cv-17026 (N.D. Ohio).
Lincoln Electric Co. and ESAB Group Inc. say any claims remaining in Richard Street's Second Amended Complaint are based on an alleged failure to warn and are untenable given Street's concession that he didn't read the warnings.
