NEW YORK - A New York appellate court has affirmed a municipal board's denial of enhanced retirement benefits sought by a police officer who claimed his cancer was caused or exacerbated by his post-9/11 work at the World Trade Center. Maldonado v. Kelly, No. 4831 [Index No. 10971/2009] (N.Y. Sup. Ct., App. Div., 1st Dept.).
The New York Supreme Court Appellate Division, First Department, ruled on July 28 that opinions offered by Eddie Maldonado's physician that his fast-growing sarcoma could be explained by exposure to unspecified toxins at the World Trade Center site were speculation, not medical opinion.
