Tennessee Judge Dismisses Silica Suit For Nondisclosure to Bankruptcy Court

GREENEVILLE, Tenn. - A federal judge said in dismissing a silica-injury lawsuit on judicial estoppel grounds that the plaintiffs' reasons for not disclosing their lawsuit as required in a bankruptcy action were "disingenuous" Walker, et ux. v. Moldex Metric Inc., No. 2:10-cv-164 (E.D. Tenn.).

Judge Leon Jordan of the U.S. District Court for the Eastern District of Tennessee granted motions for summary judgment by Moldex Metric Inc. and 3M Co. on July 25, rejecting arguments by Julius and Judy Ann Walker that any omission in their bankruptcy filings was inadvertent.
