Trial Court Faulted for Excluding Experts Based on Conclusions, not Methodology

TRENTON, N.J. - A New Jersey appellate court has ruled that two causation experts were improperly excluded from a vinyl chloride case and the court reversed summary judgment awarded to defendants by the trial court and reinstated products liability and failure-to-warn claims. Lewis v. Airco Inc., et al., No. A-3509-08T3 (N.J. Super. Ct., App. Div.).

The Appellate Division also reversed the trial court's denial of summary judgment to defendants on a civil conspiracy claims on July 15, however, saying it would join those courts requiring that such claims be based on an intentional tort.
