INDIANAPOLIS - The Court of Appeals of Indiana has reversed a trial court and ordered a workers' compensation board to provide benefits to a machinist who contended that he developed a sinus tumor from years of exposure to metal dust at his workplace. May v. Ashley F. Ward Inc., No. 93A02-1011-EX-1323 (Ind. Ct. App.).
The court said in a June 30 opinion that the claimant's medical expert's testimony and evidence from material safety data sheets provided sufficient support for the claim.
