TROY, Mich. - Michigan's Court of Appeals has reversed summary disposition for a railroad sued by a widow who contends that her late husband's brain tumor resulted from workplace exposure to toxins. Avery v. Grand Trunk Western Railroad Inc., No. 296582 (Mich. Ct. App.).
The court ruled in an unpublished opinion on June 21 that the trial court erred in barring expert medical testimony offered on behalf of Sandra K. Avery and in ruling that without that testimony there was no causative link between Robert B. Avery's fatal illness and his employment with Grand Trunk Western Railroad Inc.
