CLEVELAND - U.S. District Judge Kathleen M. O'Malley cited arguments made in a Pennsylvania welding plaintiff's opposition brief for her decision to vacate her earlier order dismissing claims against Conrail, plaintiff's former employer. Walsh v. Consolidated Rail Corp., et al., No. 1:06-cv-17286-KMO [In re: Welding Rod Products Liability Litigation, MDL No. 1535] (N.D. Ohio).

Judge O'Malley entered orders vacating the dismissal and denying Conrail's motion to dismiss on June 7, a day after she filed a written order granting Conrail's motion and counsel for plaintiff William E. Walsh Jr. filed his opposition.
