MDL Court Dismisses 22 Welding Cases for Failure to Prosecute

CLEVELAND - U.S. District Judge Kathleen M. O'Malley has granted a defense motion to dismiss 22 cases from the Welding Fume Products MDL for failure to prosecute. In re: Welding Fume Products Liability Litigation, No. 1:03-cv-17000 (N.D. Ohio).

Judge O'Malley, who presides over the coordinated Welding Fume MDL in the U.S. District Court for the Northern District of Ohio granted the motion on June 3 without comment.

Defendants' Liaison Counsel filed the motion on June 2, citing the court's May 4, 2009, order that in all cases where plaintiffs' counsel has withdrawn, the plaintiffs shall indicate within 60 days …
