MDL Court Dismisses Another 136 Welding Cases for Failure to Prosecute

CLEVELAND - U.S. District Judge Kathleen M. O'Malley has dismissed another 136 cases from the federal Welding Fume Products Liability MDL for failure to abide by the court's directive to produce medical records to support individual claims. In re: Welding Fume Products Liability Litigation, No. 1:03-CV-17000 [MDL Docket No. 1535] (N.D. Ohio).

Judge O'Malley entered the order on April 8, citing the court's orders of May 4, 2009 and July 7, 2009.

The order came on a motion by defendants in the MDL for dismissal without prejudice.
