N.Y. Judge Denies Alumina Supplier's Bid for Summary Judgment in Silica Case

ROCHESTER, N.Y. - An alumina supplier sued by a former employee of a ceramics factory was denied summary judgment in February, despite its contention that the plaintiff provided no evidence that he was exposed to silica from the defendants' products and/or ever saw the defendant's name on delivered materials. Irwin, et ux. v. Alcoa Inc., et al., No. 33-09-0799 (N.Y. Sup. Ct., Onondaga Cty.).

The firm of Whittaker, Clark & Daniels submitted its motion in Onondaga County (N.Y.) Supreme Court on Dec. 10. Plaintiffs Mark Irwin filed his opposition on Feb. 2.
