Ill. Appeals Court Denies Motorola's Bid to Transfer Birth Defects Case to Texas

CHICAGO - An Illinois appellate panel has declined to order a birth defects case against Motorola transferred to Texas, finding that Illinois retained sufficient interest in the case to warrant jurisdiction. Erwin, et al. v. Motorola Inc., No. 1-09-2847 (Ill. Ct. App., 1st Dist.).

The Illinois Court of Appeal, First District, said in its March 4 opinion that in balancing the private and public interest factors, including the availability of witnesses, it could not find that the trial court abused its discretion in denying Motorola Inc.'s motion to dismiss or transfer the case to Texas.
