Court Grants More Dismissals in Welding Fume Products MDL

CLEVELAND - The federal judge overseeing the Welding Fume Products Liability MDL dismissed more individual cases in February on motions by plaintiffs for voluntary dismissal or by defendants for failure to prosecute. In re: Welding Fume Products Liability Litigation, No. 1:03-CV-17000 [MDL No. 1535] (N.D. Ohio).

On Feb. 10, Judge Kathleen M. O'Malley granted a motion by plaintiffs Carol Petitt and Fred R. Stilson for dismissal without prejudice.

On the same day, Judge O'Malley granted a defense motion to dismiss 180 cases in which the court has allowed plaintiffs' counsel to withdraw for plaintiffs' failure to prosecute their claims.
