ST. LOUIS - A silica-exposure case scheduled for trial in federal court on Jan. 31 was instead settled on undisclosed terms 10 days before trial. Midkiff, et al. v. 3M Co., No. 4:08cv1219-DJS (E.D. Mo.).
Judge E. Richard Webber of the U.S. District Court for the Eastern District of Missouri said counsel advised the court of a settlement on Jan. 25 and the judge ordered counsel to file by Feb. 23 a stipulation for dismissal, a motion for leave to voluntarily dismiss or a proposed consent judgment.
