FORT WORTH, Texas - A Texas appellate court has affirmed a jury verdict for an employer sued over an alleged link between creosote exposure and the cancer suffered by an employee's wife. Faust v. BNSF Railway Co., No. 02-08-00226-CV (Texas Ct. App., 2nd Dist.).
The Second District Court of Appeals on Jan. 27 affirmed the verdict of the Tarrant County District Court for BNSF Railway Co. on claims that exposure to chemicals at or from the BNSF facility led to Linda Faust's illness.
