Miss. Sup. Ct. Refuses to Expedite Appeal in Boilermaker's Silica Case

JACKSON, Miss. - The Mississippi Supreme Court has rejected efforts to expedite appellate review of a ruling that allowed a former boilermaker to bring claims against several respirator defendants after he previously settled a lawsuit in which he testified that he never wore the devices. American Optical Corp., et al. v. McGraw, No. 2010-M-01005-SCT (Miss. Sup. Ct.).
Justice David Anthony Chandler signed an order Nov. 29 denying a motion by Charles Larry McGraw to expedite an interlocutory appeal filed after the high court stayed all trial court proceedings in the matter in July.
