Miss. Court Grants Additional Interlocutory Appeals, Consolidates Cases

JACKSON, Miss. - The Mississippi Supreme Court has granted additional silica defendants' petitions for interlocutory appeal and consolidated proceedings in a case challenging a trial court ruling on statute of limitations. Empire Abrasive Equipment Corp. v. Morgan, No. 2010-M-00247-SCT (Miss. Sup. Ct.).
In a Dec. 15 order, the high court said it would grant petitions filed by three defendants and stay a 2007 Adams County Circuit Court case brought by the wrongful death beneficiaries of Henry Morgan, a former sandblaster who first filed a complaint for silica-related injuries in 2002.
