LOS ANGELES - A California appellate court has affirmed dismissal of a personal injury suit by foreign workers against Dow Chemical Co. on forum non conveniens grounds, agreeing with a trial court that Michigan is a suitable alternative forum. Abrego, et al. v. The Dow Chemical Co., No. B222612 (Calif. Ct. App., 2nd Dist.).
The Second Appellate District noted in its Dec. 29 opinion that Dow Chemical has agreed to waive a statute of limitations defense that arises after the filing of this action and to apply California's discovery rule to determine when the causes of action accrued.
