Missouri Case Settles Ahead of Trial Date After Court Permits Testimony

ST. LOUIS - A Missouri silica case that was scheduled for a Nov. 29 trial has settled just weeks after a judge denied plaintiffs' motions to exclude the testimony of several plaintiff's experts. Scaggs v. 3M Co., et al., No. 08-1163 (E.D. Mo.).
According to court filings entered Nov. 19 in U.S. District Court for the Eastern District of Missouri, Mine Safety Appliances and plaintiffs Carl and Nellie Scaggs reached an agreement to resolve claims that Carl Scaggs developed silicosis despite wearing MSA and 3M Co.-manufactured respirators.
