Voluntary Dismissals Continue in Federal Welding Fume MDL

CLEVELAND - U.S. District Judge Kathleen M. O'Malley issued orders in early November approving voluntary dismissals for 39 plaintiffs in the Welding Fume Products multi-district litigation. In re: Welding Fume Products Liability Litigation, No. 1:03-cv-17000 [MDL Docket No. 1535] (N.D. Ohio).
In each instance, Judge O'Malley said the dismissals were "for good cause" and without prejudice.
In a Nov. 8 order, the judge dismissed claims filed in 2005 by Quinton Alston; Linda Brown; Felton Cooper; Gladys Johnson; and Rodger Willet.
Judge O'Malley dismissed another 34 plaintiffs on Nov. 10, including the following:
