School Plaintiffs Fail to Persuade Mass. Appellate Court to Reverse Verdict

BOSTON - A dozen Massachusetts high school students and staff members failed to persuade an appellate court to overturn a verdict in favor of the subcontractor they sued after experiencing skin rashes and respiratory problems allegedly caused by fumes from the installation of new flooring in their school. Hobbs, et al. v. TLT Construction Corp., et al., No. 09-P-1491 (Mass. Ct. App.).
The Massachusetts Court of Appeals affirmed the jury's verdict for Martin Surfacing Inc. on Oct. 27, rejecting the appellants' arguments that the trial judge provided insufficient or misleading instructions on causation or joint and several liability.
