CINCINNATI - A welding fume plaintiff whose $20.5 million damages award was overturned by the 6th Circuit Court of Appeals on Sept. 8 has asked the full court for a rehearing on whether a causation expert's testimony was properly allowed at trial. Tamraz, et ux. v. Lincoln Electric Co., et al., No. 08-4015/4016 (6th Cir.).
Jeff Tamraz argues in his Oct. 1 motion for rehearing that the panel majority that vacated the jury award failed to follow U.S. Supreme Court and Circuit Court mandates on the application of an abuse of discretion standard for reviewing trial court's Daubert decisions.
