Defense Firm Fights for $1.8 Million in Fees in Popcorn Flavorings Case

CLEVELAND - The law firm that initially defended Givaudan Flavors Corp. against allegations that an ingredient in popcorn flavorings was causing serious pulmonary problems in employees won a discovery battle in court recently over $1.8 million in unpaid billings. Squire, Sanders & Dempsey v. Givaudan Flavors Corp., No. 2010-Ohio-4469 (Ohio Sup. Ct.).
The Ohio Supreme Court on Sept. 28 reversed an intermediate court and ordered Givaudan to comply with requests from its former counsel for in-house documents and testimony relating to the diacetyl litigation that would otherwise be protected by attorney-client or work-product privilege.
