JACKSON, Miss. - A sand company named as a defendant in a Mississippi silica suit has abandoned efforts to stay the proceedings while an appeals court determines whether it has sufficient contacts with the state to justify its inclusion in the case. Specialty Sand Co. v. Nicks, No. 2010-M-1272-SCT (Miss. Sup. Ct.).
The state's Supreme Court granted a motion Sept. 2 by Texas-based Specialty Sand Co. to dismiss the interlocutory appeal of a trial court ruling that allowed plaintiff Albert Nicks to proceed with his claims against the Texas-based sand supplier.
