Jowers Defendants Ask for New Trial on Liability As Well As Damages

NEW ORLEANS - Welding products manufacturers who successfully persuaded the 5th Circuit to order a new trial on damages owed welder Robert Jowers are now asking the appellate court to amend its judgment and order a new trial on liability, as well. Jowers, et ux. v. Lincoln Electric Co., et al., No. 09-60396 (5th Cir.).
Lincoln Electric and other trial defendants filed their motion on Sept. 9, asking the court to treat the motion to amend, or "clarify," as one for rehearing if procedural rules require it.
