MDL Court Dismisses Dozens of Welding Fume Plaintiffs

CLEVELAND - U.S. District Judge Kathleen M. O'Malley has signed orders in recent weeks dismissing with prejudice dozens of additional plaintiffs from the Welding Fume Products Liability Litigation. In re: Welding Fume Products Liability Litigation, MDL No. 1535 [No. 1:03-cv-17000] (N.D. Ohio).

On Aug. 19, Judge O'Malley, who presides over the MDL in the U.S. District Court for the District of Ohio, signed an order submitted by a Virginia law to dismiss 65 plaintiffs.

The order gives those plaintiffs the right to re-file within one year.
