CLEVELAND - Defendant product manufacturers preparing for an upcoming welding trial have asked a federal judge to dismiss a claim for common law fraud, saying the Welding Fume Products Liability MDL has consistently dismissed such claims in the past. Clinger v. Lincoln Electric Co., et al., No. 1:03-CV-17000 (N.D. Ohio).
The motion was filed by The ESAB Group Inc., Hobart Brothers Co. and Lincoln Electric Co. on Aug. 9 in the U.S. District Court for the Northern District of Ohio in the lawsuit brought by James Clinger.
