Plaintiff Amends Complaint to Link Arcos to 2 Additional Companies

CLEVELAND - The judge presiding over the Welding Fume Products MDL has allowed a plaintiff to add new successor liability claims against defendant Arcos Industries LLC, despite that company's assertion that it will necessitate additional discovery and, perhaps, result in new third-party claims. Jerkins, et al. v. Airgas-Gulf States, Inc., et al., No. 1:04-cv-18810 (N.D. Ohio).

Arcos filed a brief on July 19 objecting to Charles E. Jerkins Jr.'s Motion for Leave to File a Second Amended Complaint, but Judge Kathleen M. O'Malley of the U.S. District Court for the Northern District of Ohio allowed the motion on July 27.
